David King is a trial and appellate lawyer with a decade of experience in a wide spectrum of complex commercial litigation. David’s practice has included substantive briefing in federal district and appellate courts as well as advising clients on how to avoid or best position themselves for future litigation. In any context, David brings a thoughtful, analytic, and strategic approach to his work.
Adept at identifying the crux of the legal issues his clients face, David has tackled an array of legal matters—ranging from consumer protection and bankruptcy litigation to antitrust issues, trade secret disputes, breach of contract, and white collar litigation. His versatility spans various sectors, including finance, manufacturing, technology, and food and beverage, among others.
Prior to joining the firm, David was an attorney with the Consumer Financial Protection Bureau. He represented the Bureau as plaintiff and defendant; in district and appellate courts; in consumer protection matters, constitutional challenges, and employment litigation. He also advised Bureau decision makers on administrative law issues in high-profile rulemakings and on the interpretation of federal consumer financial law.
David began his legal career as a law clerk to Judge David S. Tatel on the D.C. Circuit. Prior to attending law school, David was a Peace Corps volunteer in Mozambique, where he taught high school chemistry and English for two years.
Representative Matters
Represented Arconic, a global manufacturing company, in a high-profile trade secret and antitrust case against Novelis in the Western District of Pennsylvania, alleging Novelis misappropriated Arconic's proprietary pretreatment process for aluminum sheeting, which is used in Ford's F-150 pickup truck. Led the briefing of cross-motions for summary judgment, argued crucial segments of these motions, and played a significant role in additional briefings. Managed pre-trial preparations, including drafting jury instructions, handling deposition designations, and negotiating stipulations.
Led the charge on briefing legal issues, which played a pivotal role in achieving a complete acquittal in a high-profile federal criminal and antitrust trial. This case, brought by the Department of Justice, accused many individuals in the broiler chicken industry—worth $28 billion annually—of fixing prices over an eight-year span. This victory was recognized as “Behavioural Matter of the Year 2023 (Americas)” by Global Competition Review and was also a first runner-up for The AmLaw Litigation Daily's “Litigator of the Week.” The case drew widespread attention from national media, including major outlets like The Wall Street Journal, Bloomberg, Forbes, Reuters, Politico, and CNBC.
Representing a major architectural hardware and glazing supply company in a multi-hundred-million dollar matter, which involves related litigation in an AAA arbitration, federal court, California state court, and bankruptcy court. Breach of contract, patent, trade secret, and computer fraud and abuse act issues are at play in the case.
Defended NatWest Capital Markets in SIPA adversary proceedings brought by the Madoff Trustee in bankruptcy court.
